论有效预防报复社会型犯罪的法治思路——基于实证案例的分析

摘要 研究和反思报复社会型犯罪的特点及我国的应对措施在学术上和现实中具有重要价值。以102份已公开的判决文书为样本的实证研究显示:报复社会型犯罪案件不仅难预防,而且呈现持续增长的态势。这与改革开放以来中国社会的经济发展和社会观念的变化有关。报复社会型犯罪的发生,常使公私财产遭受重大损失或造成人员重大伤亡。为预防这类犯罪,我国采取了设置申诉渠道、重点区域安全检查、施加法律责任等三种传统预防方式。这些措施在一定程度上有效预防了报复社会型犯罪的发生,但已接近了自身作用的极限。有鉴于此,我国应该在已有经验的基础上,尝试采取建立重点人员清单制度、提升公民预防能力、进行专项立法等措施,以有效预防这类严重破坏社会和谐氛围、造成社会恐慌案件的发生。 It is of great academic and practical value to study and reflect on the characteristics of retaliatory social crimes and the countermeasures to be adopted in China.based on 102 public judgment documents,the empirical study shows that the cases of retaliation social crime are not only difficult to prevent,but also show a continuous growth trend,which is related to the economic development and the change of social concept in China since the reform and opening up.Every occurrence of revenge-on-society crime has often caused great losses to the public and private properties or heavy casualties.In order to prevent the occurrence of such crimes,our country has adopted three traditional methods:setting up appeal channels,security inspections in key areas,and imposing legal liabilities.These measures have effectively prevented the occurrence of retaliatory social crimes to a certain extent.However,these measures seem to have reached their own limits.In view of this,the Chinese government should try to implement measures such as establishing a list of key personnel,improving citizens′preventive capabilities,and special legislation based on its existing experience so as to effectively prevent such cases that severely disrupt social harmony and cause social panic.
